Contents of the report:
The Management of Barlinek S.A. (the Issuer) hereby announces that on June 17th 2009 it received a ruling from the Szczecin-Centrum Regional Court in Szczecin from June 4th 2009 regarding entering a pledge on mobile property, marked as to type and being the property of Barlinek Inwestycje Spółka z o.o. in Barlinek (a subsidiary of Barlinek SA) towards ABN AMRO Bank (Polska) S.A. based in Warsaw, onto the register of pledges.
The registered pledge constitutes a safeguard on credit granted by ABN AMRO Bank (Polska) S.A. to the Issuer and Barlinek Inwestycje Sp. z o.o. in accordance with the credit agreement signed on December 31st 2008 (Current Report nr 1/2009).
The registered pledge was established on goods and raw materials for manufacturing owned by Barlinek Inwestycje Sp. z o.o., i.e. inventory and complete products marked as to type and having a registered value of 76,063,416.67 PLN on November 30th 2008. Value of liabilities safeguarded by the pledge - 50,000,000 złotys.
There are no links between Barlinek S.A. and ABN AMRO Bank (Polska) S.A. There are also no links between managing or supervisory persons in Barlinek S.A. and managing or supervisory persons in ABN AMRO Bank (Polska) S.A.
Criteria for considering the assets to be of significant value - the value of the sum safeguarded by the pledge exceeds 10% of Barlinek SA’s equity capital.
Legal basis: § 5 item 1 point 1 of the Ordinance of the Minister of Finance of 19 February 2009 regarding current and periodic information to be submitted by issuers of securities and the conditions for recognition as equivalent of the information whose disclosure is required under the laws of a state which is not an EU member state (Journal of Laws No 33/2009, item 259).
